Terms of service

These terms govern your use of rowmine.com and any purchase you make from us. By using this website or placing an order, you accept these terms. Please read them.

Row Mine — ABN 37558724556, of Queensland, Australia ("we", "us", "our"). "You" means the person using this website or placing an order.

1. Nothing here limits your consumer rights

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Where anything in these terms conflicts with the Australian Consumer Law, or with any other law that cannot be excluded, that law prevails and the conflicting part of these terms does not apply. Nothing in these terms is intended to exclude, restrict or modify any right or remedy you have under those laws.

If you are a consumer in the European Union or United Kingdom, mandatory consumer protections in your country of residence apply in addition to these terms — see clause 12.

2. Eligibility to purchase

To place an order you must be at least 18 years old and legally able to enter a contract, and be using a payment method you are authorised to use.

We may refuse or cancel any order at our discretion, including where we suspect fraud, where an order breaches these terms, where we cannot verify your details, or where an order appears to be for resale. If we cancel an order you have paid for, we refund you in full.

3. Products, descriptions and images

We describe our garments as accurately as we can, but:

Colours vary between screens. We cannot guarantee that what you see on your device matches the garment exactly.
Our materials are natural. Full-grain leather, wool and natural fibres carry inherent variation in grain, tone, texture and marking. These are characteristics of the material, not defects — our Returns & Refunds policy sets this out in full.
Measurements are approximate and subject to normal manufacturing tolerance.
Product imagery is representative. Styling items shown alongside a product are not included unless expressly stated.

We may change or discontinue any product at any time without notice.

4. Pricing and payment

All prices are in Australian dollars (AUD) and include GST where applicable. Prices exclude shipping, and exclude any import duties or taxes charged by a destination country — see our Shipping policy.

Prices may change at any time, but a change will not affect an order we have already accepted.
Pricing errors. If a product is listed at an obviously incorrect price through human or system error, we are not obliged to supply it at that price. We will contact you, and you may confirm the order at the correct price or cancel it for a full refund.
Payment is taken at the time of order. We accept the methods shown at checkout.
Instalment providers. Where you pay via Afterpay or a similar provider, your agreement with that provider is separate from your contract with us and is governed by their terms. Any fees, interest or collection activity are a matter between you and them.
We do not store your full card details. Payments are processed by our payment providers.

5. When a contract is formed

Displaying a product on our website is an invitation to treat, not an offer.

Your order is an offer to buy. Our order confirmation email acknowledges receipt but does not form a contract. A contract is formed only when we dispatch the goods, and only for the goods actually dispatched.

This means we can decline an order after payment — for example if an item is out of stock, mispriced, or we cannot ship to your address. If we do, we refund you in full.

6. Stock and availability

Our collections are produced in small, finite runs. Listing a product does not guarantee availability.

Where an item becomes unavailable after you order, we will contact you and offer a replacement, a backorder, or a full refund. Where an order contains several items and one is unavailable, we may ship the remainder and refund the balance.

Pre-orders are charged at the time of order and ship on the timeline stated on the product page. Pre-order dates are estimates. Where a pre-order is delayed materially beyond the stated window, you may cancel for a full refund.

7. Shipping, returns and cancellation

Shipping is governed by our Shipping policy. Returns, refunds, faults and cancellations are governed by our Returns & Refunds policy. Both policies form part of these terms.

8. Your account

If you create an account, you are responsible for keeping your login details secure and for activity under your account. Tell us immediately if you suspect unauthorised use. We may suspend or close an account that breaches these terms.

9. Acceptable use

You may use this website for lawful purposes only. You must not:

use the site in a way that breaches any law, or infringes anyone's rights;
attempt to gain unauthorised access to the site, its servers or any connected system;
introduce malicious code, or interfere with the site's operation;
scrape, harvest or systematically extract content or data, or use automated systems to place orders;
purchase for commercial resale without our written agreement;
submit false, misleading or fraudulent information.

We may suspend or terminate your access for any breach.

10. Intellectual property

All content on this website — including the Row Mine name and marks, garment designs, photography, film, text, graphics and layout — is owned by us or licensed to us and is protected by Australian and international law.

You may view and print content for your own personal, non-commercial use. You must not otherwise copy, reproduce, distribute, modify, publish or exploit any content commercially, or use our marks, without our prior written permission.

Content you submit. If you submit reviews, photographs, comments or tag us on social media, you grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce and display that content in connection with our business, including in marketing. You confirm you own or control the rights to it. We may remove any submitted content at our discretion.

11. Liability

Subject always to clause 1:

To the extent permitted by law, our total liability arising out of or in connection with a product or your use of this website is limited, at our option, to replacing the goods, supplying equivalent goods, repairing the goods, or paying the cost of any of those things.
To the extent permitted by law, we are not liable for indirect, incidental, special or consequential loss, or for loss of profit, revenue, data, business or opportunity, however arising.
We do not warrant that this website will be uninterrupted, error-free, secure or free of viruses, and we are not liable for loss arising from your use of it or from any linked third-party site.
We are not liable for failure or delay caused by events beyond our reasonable control, including carrier disruption, customs action, industrial action, natural events, pandemic, or failure of payment or communications infrastructure.

Care of your garment. Our garments are supplied with care instructions. We are not liable for damage caused by improper care, misuse, alteration, or repair or cleaning by a third party.

12. International customers

We ship to the destinations listed at checkout. You are responsible for ensuring the goods may lawfully be imported into your country, and for any import duties, taxes or charges.

European Union and United Kingdom. If you are a consumer resident in the EU or UK, you have a statutory right to withdraw from a distance purchase within 14 days of receiving the goods, without giving a reason, and to a refund including the cost of standard outbound delivery. You bear the cost of returning the goods. These rights apply in addition to our Returns & Refunds policy, which is more generous in its window. To exercise the right of withdrawal, email us within 14 days of delivery.

Nothing in these terms deprives a consumer of the protection of mandatory provisions of the law of their country of habitual residence.

13. Privacy

Your personal information is handled in accordance with our Privacy Policy, which forms part of these terms.

14. Changes to these terms

We may update these terms at any time by posting a revised version on this page. The version in force at the time you place an order governs that order. Continued use of the site after a change constitutes acceptance of the revised terms.

15. Governing law

These terms are governed by the laws of Queensland, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Queensland and the courts able to hear appeals from them.

If you are a consumer resident outside Australia, this clause does not deprive you of the protection of the mandatory laws of your country of residence, or of the right to bring proceedings there where the law gives you that right.

16. General

Severability. If any part of these terms is found unenforceable, the rest continues in force.
No waiver. If we do not enforce a right, that is not a waiver of it.
Entire agreement. These terms, together with our Shipping, Returns & Refunds and Privacy policies, form the entire agreement between us regarding your use of this website and your orders.
Assignment. You may not assign your rights under these terms. We may assign ours in connection with a sale or restructure of our business.
